  1. Tax Exemptions/Refunds Overview If you use clear diesel fuel for off-road purposes, you may be eligible for tax exemptions and refunds. This could apply to industries such as construction, mining, and other off-highway uses. For Ag related exemptions, click here. Keep in mind, dyed diesel does not have any additional off-road tax exemptions available. If you are using dyed diesel, you do not need to complete this form.                                                                                                                                                                                               
  2. Exemption Rates The exemption rates for clear diesel used off-road can vary, so please consult your tax professional. However, as of August 2024, typical exemption/refund rates are as follows:
  • Sales Tax = 5.75% exemption (from the full 13.00%) for a net tax due of 7.25%. This is before district taxes for your area are added to that rate.
  • CA Excise Tax Exemption = 45.4 cents per gallon
  • Fed Excise Tax Refund = 24.4 cents per gallon

  • Proof of diesel purchases used in off-road equipment
  • Documentation of the specific usage of the diesel fuel
